Terms of Service

By accessing or using My Business Is Your Business ("we," "our," "us," or "the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

1. What This Platform Is — and Isn't

My Business Is Your Business is a verification and transaction-facilitation platform. We help independent business buyers and sellers connect, verify each other's identity, and manage a structured process around a private business sale.

We do not hold, transfer, or have custody of your sale proceeds at any point. When a buyer and seller agree to a deal, the actual purchase price is paid directly between the buyer and seller, through whatever payment method they arrange between themselves (bank wire, check, escrow company, or otherwise). The Platform is never a party to that transfer of funds and never holds any portion of the sale price at any time.

The only payments that pass through the Platform are:

We are not a law firm, financial advisor, accountant, licensed business broker, escrow agent, or money transmitter. Users are entirely responsible for conducting their own legal, financial, and tax due diligence before completing any business purchase or sale, and for arranging the actual transfer of sale funds through a method of their own choosing.

2. Eligibility & Account Security

You must be at least 18 years old to use this platform. You are entirely responsible for maintaining the confidentiality of your secure magic-link login and all recorded data updates submitted under your account.

3. Pricing & Fees

By using the Platform, you agree to the following pricing structure, current as of the Effective Date above:

All fees are processed securely through Stripe. We do not store your payment card information.

4. How Deal Closing Works

The Platform relies on the seller's own confirmation that a deal has closed in order to trigger the 5% success fee. We do not independently verify that a closing has occurred, that funds have actually changed hands, or the terms under which a deal closed. Sellers are expected to only confirm a closed deal in good faith and after the transaction has genuinely completed. Misuse of this feature may result in account suspension.

5. Identity Verification

Buyer identity verification is provided through a third-party verification service (Stripe Identity) and may include document and/or live photo capture. A completed verification confirms identity to the standard provided by that service; it is not a guarantee of a buyer's financial capacity, intent, or trustworthiness, and sellers should conduct their own additional diligence before proceeding with any transaction.

6. No Guarantee of Outcome

We do not guarantee that any listing will result in a completed sale, that any buyer or seller will act in good faith, or that any transaction facilitated through the Platform will be successful, profitable, or free of disputes. The Platform provides tools to support a transaction; it does not participate in, negotiate, or guarantee the underlying business sale itself.

7. Limitation of Liability

To the fullest extent permitted by law, My Business Is Your Business shall not be liable for any indirect, incidental, or consequential damages, transaction failures, disputes between buyers and sellers, or financial outcomes arising from the use of the platform — including, without limitation, any loss connected to funds transferred directly between a buyer and seller outside the Platform. Our maximum liability shall not exceed the total amount of fees you have paid directly to the Platform in the twelve (12) months preceding the claim.

8. Account Suspension & Termination

We may suspend or terminate access to the Platform for any account that we reasonably believe is being used fraudulently, to circumvent fees, to falsely confirm a closed deal, or in violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. Material changes will be reflected by an updated Effective Date above.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable state business regulations. Questions regarding these terms may be directed to support@mybizisyourbiz.com.
